Terms & Conditions

Official service agreement, statutory liabilities, and terms of engagement governing engineering consultancy and laboratory testing services by Namotech.

These Terms & Conditions ("Terms") govern your access to the Namotech Consultancy Services LLP ("Namotech", "we", "our", "us") website and all engineering, consultancy, and testing engagements. By accessing our platform or signing an agreement, you agree to be bound by these Terms.

1Acceptance of Terms

By accessing our website (www.namotech.in) or contracting Namotech for any structural consultancy, NDT, material testing, safety audit, or surveying services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

2Services Provided

Namotech provides multi-disciplinary engineering solutions across India and internationally:

Engineering Consultancy:Structural design, proof consultancy, BIM modeling, MEP, PMC, DPR preparation, and cost estimation.
Laboratory Testing:NABL-accredited mechanical and chemical testing of concrete, steel, soil, aggregate, and bitumen (TC-7290).
Surveys & Investigations:Geotechnical drilling, SPT, plate load tests, topographical surveying, LiDAR, and drone mapping.
Safety Audits & Compliance:Factories Act Form-28 stability certification, NBC 2016 fire audits, PESO safety audits, and road safety audits.

* Specific deliverables, timelines, and commercial terms are defined within the respective formal contract or purchase order.

3Use of Website

You agree to use our website only for lawful business purposes. You must not:

  • Engage in automated scraping, data extraction, or stress testing of the platform without written authorization.
  • Attempt unauthorized access to server infrastructure, APIs, or client test reports.
  • Submit fraudulent project requirements, counterfeit certificates, or misleading RFP submissions.

4Intellectual Property

All intellectual property — including design calculation sheets, CAD drawings, NABL test methodologies, algorithms, website code, and technical whitepapers — belongs exclusively to Namotech Consultancy Services LLP.

Deliverables provided to clients (such as structural fitness certificates or GFC drawings) may be utilized solely for the agreed project scope. Reproduction for alternative sites is strictly prohibited without formal licensing.

5Reports & Test Certificates

All engineering reports, forensic structural certifications, and laboratory test results are subject to the following principles:

Scope Specificity: Test results relate strictly to the specific batch, core specimen, or physical location tested at the date of sampling.
NABL Integrity: NABL accredited certificates (Certificate No. TC-7290) must not be reproduced except in full. Partial extract reliance is legally invalid.
Code Governing: Assessment interpretations reflect Indian standard codes (IS, IRC, NBC) effective on the date of issuance.
Notice: Namotech accepts zero liability for third-party misapplication, structural modifications executed without supervisory engineering clearance, or unapproved contractor variations.

6Client Responsibilities

For seamless execution of consultancy and field testing, clients agree to:

  • Provide unhindered, safe site access and mandatory health & safety clearances.
  • Supply accurate architectural plans, structural drawings, historical data, and geotechnical soil reports.
  • Adhere to agreed milestone payment terms to avoid project suspension or test certificate release delays.

7Limitation of Liability

To the fullest extent permissible under Indian Law:

  • Namotech's aggregate liability for direct damages arising under any work order shall not exceed the professional fees received for that specific service.
  • We bear no liability for consequential loss, downtime, commercial revenue forfeiture, or force majeure occurrences.

8Confidentiality

All proprietary client blueprints, process schematics, plant distress disclosures, and security audits are treated under strict professional non-disclosure protocols.

We are prepared to execute bilateral Non-Disclosure Agreements (NDAs) prior to commencing sensitive forensic investigations or infrastructure due diligence.

9Payment Terms

Invoices are generated against agreed milestones (mobilization advance, intermediate submission, final GFC handover, or laboratory test sign-off). Applicable GST will be levied at standard statutory rates.

* Official NABL test certificates are released upon receipt of full settlement.

10Governing Law & Arbitration

These Terms shall be interpreted in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the competent courts in Jaipur, Rajasthan, subject to prior resolution via the Arbitration and Conciliation Act, 1996.
